Welcome to Lolly Budget ("App", "we", "our", or "us"), a DBA of Avocado Orbit LLC. By accessing or using our App, you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our App.

5. Subscription and Billing

Our App operates on a subscription basis. By subscribing to our services, you agree to pay the fees associated with your selected subscription plan. Fees are billed in advance on a recurring basis, depending on your subscription cycle. You authorize us to charge your payment method for these fees.

6. User Responsibilities

You agree to use our App only for lawful purposes and in accordance with these Terms. You agree not to use our App:

• To attempt to gain unauthorized access to any portion of the App or any other systems or networks connected to the App

The App and its original content, features, and functionality are and will remain the exclusive property of Avocado Orbit LLC (DBA Lolly Budget) and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Avocado Orbit LLC.

8. User Content

Our App may allow you to input and store content such as budget information, financial goals, and other personal data. You retain all rights to your content, and you are responsible for it. By providing content to our App, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute your content solely for the purpose of providing our services to you.

9. Limitation of Liability

In no event shall Avocado Orbit LLC (DBA Lolly Budget), nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Avocado Orbit LLC (DBA Lolly Budget) does not warrant that (i) the App will function uninterrupted, secure or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the App is free of viruses or other harmful components; or (iv) the results of using the App will meet your requirements.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. 1. Subscription Cancellation

You may cancel your subscription to Lolly Budget at any time. To cancel your subscription, log into your account settings and select the cancellation option, or contact our customer support team at support@lollybudget.com.

2. Refund Policy

We offer refunds according to the following terms:

• Monthly Subscriptions: For monthly subscriptions, cancellations will take effect at the end of your current billing cycle. No partial refunds are provided for the remainder of the billing cycle.
• Annual Subscriptions: For annual subscriptions, you may be eligible for a prorated refund of the unused portion of your subscription if you cancel within 30 days of your most recent payment.
• Trial Period: If you cancel during a free trial period, no charges will be applied.

3. Plan Upgrades and Downgrades

You may upgrade or downgrade your subscription plan at any time:

• Upgrades: When upgrading your plan, you will be charged the difference between your current plan and the new plan on a prorated basis for the remainder of your current billing cycle. The new plan's features will be available immediately upon upgrade.
• Downgrades: When downgrading your plan, the changes will take effect at the beginning of your next billing cycle. You will continue to have access to your current plan's features until the end of your current billing cycle.

4. Account Data After Cancellation

Upon cancellation, your account will be deactivated and your access to the App will be terminated. We will retain your account data for a period of 30 days after cancellation, during which time you may request a copy of your data. After this 30-day period, your data will be permanently deleted from our active systems, although residual copies may remain in our backup systems for a limited time in accordance with our data retention policies and applicable law.

5. Renewal and Automatic Billing

Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. By subscribing to our services, you authorize us to charge your payment method for the subscription fee at the then-current rate plus any applicable taxes.
